      <para>Novartis c.s. maakt onderdeel uit van het Zwitserse farmaceutische bedrijf Novartis dat gericht is op het onderzoek, ontwikkelen en verhandelen van innovatieve geneesmiddelen.</para>
      <para />
    </paragroup>
    <paragroup>
      <nr>2.2.</nr>
      <para>Novartis AG en Novartis-Erfindungen Verwaltungsgesellschaft m.b.H. zijn houdster geweest van het stofoctrooi EP 0 663 916 B1 (hierna: EP 916) voor <emphasis role="italic">“O-alkylated rapamycinederivaat en het gebruik ervan als immunosuppressivum”</emphasis>, welk octrooi ziet op de stof everolimus. Dit is de internationale generieke benaming voor de verbinding 40-O-(2-hydroxy)ethyl-rapamycine, een hydroxyethylderivaat van rapamycine zoals dat in de natuur voorkomt. Everolimus remt de activatie van T-cellen, en kan gebruikt worden als een immuunonderdrukkend geneesmiddel (“immunosuppressant”). Everolimus werd oorspronkelijk goedgekeurd voor gebruik bij nier-, hart- en levertransplantatie. Na het aanvullend beschermingscertificaat en een pediatrische verlenging van zes maanden is de bescherming van EP 916/everolimus geëindigd op 18 januari 2019.</para>

De aanvraag is gepubliceerd op 29 augustus 2002 en doet een beroep op het prioriteitsdocumenten GB 0104072.4, gedateerd 19 februari 2001, en GB 0124957.2 (hierna: GB 572), gedateerd 17 oktober 2001. The efficacy of the treatment can be determined in such studies, e.g., after 12, 18 or 24 weeks by radiologic evaluation of the tumors every 6 weeks. </emphasis>

          <emphasis role="italic">Daily dosages required in practicing the method of the present invention when a compound of formula I alone is used will vary depending upon, for example, the compound used, the host, the mode of administration and the severity of the condition to be treated. Door de aankondiging van het voornemen van Teva om Everolimus Teva per 1 juli 2019 in Nederland op de markt brengen (en de geplande opname in de juli-editie van de G-standaard) is er een concrete dreiging van directe inbreuk (dan wel van indirecte inbreuk op de octrooien, dan wel handelt Teva onrechtmatig jegens Novartis c.s.), waarmee Novartis c.s. recht heeft op en belang bij de voorlopige maatregel.</para>

      <para>Aangezien Teva in Nederland is gevestigd, is de voorzieningenrechter van deze rechtbank bevoegd van de vorderingen kennis te nemen op grond van het bepaalde in artikel 4 en 35 Brussel I bis-Vo<footnote-ref linkend="_efcf0dd6-053f-4cde-a9cb-d61ba3d452ab" /> en artikel 80 lid 2 onder a ROW<footnote-ref linkend="_2821424c-f7c0-4ae2-92e8-3c806b56535f" />.</para>

      <para>EP 603 is naar voorlopig oordeel niet inventief, althans is er een serieuze, niet te verwaarlozen kans dat het octrooi in een daartoe strekkende bodemprocedure op die grond voor nietig wordt gehouden. Daartoe is het volgende redengevend.</para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.4.</nr>
      <para>Voorop gesteld wordt dat inventiviteit ontbreekt als de gemiddelde vakman, uitgaande van de meest nabij stand van de techniek, het probleem zou (<emphasis role="italic">would</emphasis>) - en niet slechts kon (<emphasis role="italic">could</emphasis>) - hebben opgelost op de wijze geclaimd in het octrooi. Zo de uitvinding het resultaat is van nader onderzoek, ligt de uitvinding niet alleen voor de hand als de vakman dat onderzoek zou hebben uitgevoerd en de resultaten duidelijk voorspelbaar zijn, maar ook als er sprake is van een redelijke verwachting van succes (<emphasis role="italic">reasonable expectation of success</emphasis>), dat wil zeggen dat de vakman in staat is om redelijkerwijs een succesvol einde van een onderzoeksproject binnen acceptabele tijd te voorspellen. Onvoldoende is de enkele <emphasis role="italic">“hope to succeed”</emphasis>.<footnote-ref linkend="_9fff3682-3511-4997-81ca-b4eec319d8b1" /></para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.5.</nr>
      <para>Bij de beoordeling van de inventiviteit zal de voorzieningenrechter de PSA<footnote-ref linkend="_412def5e-916e-493b-80b2-82eecaa6d668" /> hanteren. Teva heeft aangevoerd dat de onderhavige zaak minder geschikt is voor toepassing van de PSA, omdat het kiezen van de meest nabije stand van de techniek in enige mate het zicht ontneemt op het gehele veld van kankeronderzoek, met name ook met betrekking tot combinaties van antikankermiddelen. Wat daar ook van zij, nu de voorzieningenrechter ook met de toepassing van de PSA-methodiek tot het voorlopig oordeel komt dat geen sprake is van inventiviteit, kan deze methodiek in de onderhavige procedure worden gevolgd.</para>

      <nr>4.6.</nr>
      <para>De voorzieningenrechter is - met partijen - van oordeel dat de gemiddelde vakman een in borstkanker gespecialiseerde klinisch oncoloog is (hierna: de vakman). </para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.7.</nr>
      <para>Als meest nabije stand van de techniek dient te worden aangemerkt het document dat het geschiktste uitgangspunt vormt om tot de uitvinding te komen. Dat zal als regel het document zijn dat zich bezighoudt met hetzelfde probleem en de meeste met de uitvinding overeenstemmende kenmerken openbaart. Dat laat onverlet dat een octrooi(conclusie) (nieuw en) inventief behoort te zijn ten opzichte van elke openbaarmaking die onderdeel vormt van de stand van de techniek en als een reëel uitgangspunt voor de PSA kan dienen.</para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.8.</nr>
      <para>Naar voorlopig oordeel is WO 467 een reëel uitgangspunt als (meest nabije) stand van de techniek. Partijen hebben ook beide (subsidiair) de (niet-)inventiviteit van EP 603 (en EP 246) vanuit WO 467 beargumenteerd.</para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.9.</nr>
      <para>WO 467 ziet op een combinatietherapie voor de behandeling van borstkanker, waarbij wordt ingezet op verschillende combinaties van aromataseremmers en antineoplastische middelen. Daarbij levert de combinatie van bij voorkeur exemestaan als aromataseremmer, met met name de cytotoxische chemotherapeutica epirubicine of docetaxel (antineoplastische middelen), een “<emphasis role="italic">superadditive antitumor effect</emphasis>” op (vergelijk de beschrijving en de tabellen 1 en 2 onder 2.15.1). Daarnaast is een belangrijk voordeel van de combinatietherapie dat de toxiciteit van de behandeling significant wordt verlaagd ten opzichte van de monotherapie met enkel een chemotherapeuticum (vergelijk de eerste onder 2.15.1 geciteerde paragrafen). </para>
      <para />
    </paragroup>

      <nr>4.10.</nr>
      <para>De verschilmaatregel tussen conclusie 1 van EP 603 en WO 467 is de toepassing van everolimus in plaats van de specifiek genoemde antineoplastische middelen epirubicine of docetaxel. Het technisch effect van deze verschilmaatregel is het voorzien in een alternatief voor een antineoplastisch middel dat in combinatie met exemestaan op vergelijkbare wijze werkzaam is tegen borstkanker/aBC. Daarbij wordt de stelling van Novartis c.s. verworpen dat het technisch effect van de toepassing van everolimus in combinatie met exemestaan, een verbeterde hormoon-gebaseerde therapie is voor borstkanker ten opzichte van de combinaties gesuggereerd in WO 467 of andere behandelingen die op de prioriteitsdatum bekend waren. Die verbeterde werking is immers niet in de oorspronkelijke aanvraag (WO 019, zie 2.3) terug te lezen en daarin ook niet plausibel gemaakt. </para>
      <para />
      <paragroup>
        <nr>4.10.1.</nr>
        <para>In de oorspronkelijke aanvraag is geen informatie opgenomen over de werking van everolimus (compound A) in combinatie met enige hormoonbehandeling, laat staan met een hormoonbehandeling in de vorm van een aromataseremmer zoals exemestaan. In de aanvraag ontbreken data waaruit volgt dat de combinatie van everolimus en exemestaan (synergetisch) werkzaam is bij de behandeling van borstkanker. Er wordt in zijn algemeenheid verwezen naar vele soorten van vaste tumoren (zie onder 2.3, de paragraaf over “solid tumors” waarin “breast tumors” is onderstreept, voetnoot 2). </para>

        <nr>4.10.2.</nr>
        <para>De in vitro en in vivo experimenten in de aanvraag waarnaar Novartis c.s. verwijst ter onderbouwing van haar standpunt, te weten A1, B4 en B7 (zie 2.3), verstrekken evenmin nadere informatie. A1 ziet op een in vitro experiment waarbij everolimus in combinatie met verschillende cytostatica (cisplatine, doxorubicine, gemcitabine en paclitaxel) is getest op cellijnen afkomstig van long-, pancreas- en huidkanker. B4 en B7 beschrijven in vivo experimenten waarbij respectievelijk de combinatie van everolimus met het cytostaticum doxorubicine en de combinatie van everolimus met een VEGF receptor tyrosine kinaseremmer op huidkanker is getest. Enerzijds is in geen van de experimenten (in vitro of in vivo) everolimus (compound A) getest in combinatie met een hormoonbehandeling (in de vorm van een aromataseremmer zoals exemestaan) en anderzijds hebben de testen die wel zijn uitgevoerd geen betrekking op borstkanker. </para>
        <para />

        <nr>4.10.3.</nr>
        <para>De enkele opname in de aanvraag - zakelijk weergegeven - dat de uitvinding tevens het gebruik van een combinatie in de behandeling van borstkanker behelst, waarbij een aromataseremmer onderdeel uitmaakt van deze combinatie (zie onder 2.3 einde, voetnoot 12), maakt het niet anders. In de oorspronkelijke aanvraag is deze paragraaf opgenomen in een rij van suggesties van combinaties die de uitvinding belichaamt en wordt bovendien (anders dan in de beschrijving van EP 603) niet enkel een aromataseremmer genoemd maar eveneens vele andere antikankermiddelen.<footnote-ref linkend="_3bf27ef9-7f37-426e-a219-137b5379fdce" /> Voor zover de aanvraag de vakman al de combinatie van everolimus en exemestaan bij de behandeling van borstkanker/aBC zou openbaren,<footnote-ref linkend="_e357f077-59f7-42b0-be43-d64b73bd8cc7" /> volgt uit deze paragraaf niet dat de combinatietherapie een verbeterd of synergetisch effect sorteert. </para>

      </paragroup>
      <paragroup>
        <nr>4.10.4.</nr>
        <para>In zoverre Novartis c.s. het standpunt inneemt dat het op grond van de gunstige onderzoeksresultaten van everolimus met enkele andere chemotherapeutische middelen als beschreven in de aanvrage, aannemelijk is dat dit ook naar everolimus met exemestaan voor borstkanker kan worden geëxtrapoleerd, faalt dit betoog. In de aanvraag noch in de algemene vakkennis destijds is een algemeen principe of een theorie opgenomen welke verbeterde werking van die combinatie aannemelijk maakt. Ook de deskundige van Novartis c.s., prof. dr. S.R.D. Johnston, verklaart niet dat de aanvraag/het octrooi een verbeterde werking openbaart of aannemelijk maakt. Hij verklaart ten aanzien van plausibiliteit slechts dat de combinatie van everolimus met een aromataseremmer/exemestaan effectief <emphasis role="italic">zou</emphasis> kunnen zijn tegen aBC:</para>

            <emphasis role="italic">“</emphasis>
            <emphasis role="bold italic">Plausibility</emphasis>
          </para>
          <para>
            <emphasis role="italic">165. Having regard to the disclosure in the specification of EP ‘603, I consider that the skilled person at the Application Date would have thought it entirely plausible that the combination of everolimus and exemestane could be effective in the treatment of HR-positive breast tumours.</emphasis>
          </para>
          <para>
            <emphasis role="italic">166. I also consider that, in light of the disclosure of EP ‘246, the skilled person at the Application Date would have thought it entirely plausible that the combination of everolimus and an aromatase inhibitor could be effective in the treatment of HR-positive breast tumours.</emphasis>

        <parablock>
          <para>Meer algemeen ten aanzien van combinatietherapieën verklaart Johnston voorts (enigszins geparafraseerd) dat het lastig te voorspellen is of er synergie of een verbetering optreedt:</para>
        </parablock>
        <para />
        <para>
          <emphasis role="italic">63. One of the key issues that must be addressed in the development of a combination therapy is whether and how the chosen combination agents interact, both from an efficacy perspective as well as from a safety perspective.</emphasis>
        </para>
        <para>
          <emphasis role="italic">64. From an efficacy perspective the ideal is for the chosen compounds to have a synergistic effect when administered in combination - i.e. the therapeutic efficacy of the combination is greater than the sum of its parts. An additive effect, wherein the combination is about as effective as the sum of its parts, can also represent a useful clinical outcome. An antagonistic interaction, wherein the combination treatment is less effective than the sum of its parts, would generally be an unwelcome result and represent a failed combination. It is not uncommon for combinations to exhibit no additional benefit over monotherapy, or even a reduced benefit compared to monotherapy. This is particularly the case in the oncology setting, where the disease the skilled person is attempting to treat is highly complex, heterogeneous in its manifestations and able to adapt in response to attempted treatment. In this respect, even amongst cancers, HR-positive advanced or metastatic breast cancer is considered to be a very adaptable tumour.</emphasis>
        </para>
        <para>
          <emphasis role="italic">65. From a safety perspective, administering multiple treatments at the same time as combination partners may require careful management of respective side effects (which may compound one another) as well as consideration of the risk of an unwanted drug-drug interaction between the two compounds. Although the fact that chosen combination partners generally operate through different mechanisms of action (and thus aim to affect different signalling pathways in the body) theoretically reduces the chance of an unwanted interaction between the two compounds, a development team cannot be sure of the precise effect of the combination in real life patients until it is tested in clinical trials.</emphasis>
        </para>
        <para />

          <para>Volgens Johnston kan er derhalve ook geen combinatie-effect (i.e. niet meer dan de som van het effect van elk middel afzonderlijk) of zelfs een antagonistisch effect (i.e. de middelen werken elkaar tegen) optreden. Een wetenschappelijk verantwoorde voorspelling aan de hand van de gegevens in de oorspronkelijke aanvrage (of zelfs het verleende octrooi) dat everolimus met een aromatase remmer of specifiek exemestaan, een verbeterd of synergetisch effect zal hebben tegen aBC is naar voorlopig oordeel niet aan de orde. </para>
        </parablock>

      </paragroup>
      <paragroup>
        <nr>4.10.5.</nr>
        <para>Voor zover Novartis c.s. met haar opmerking dat vaststaat dat de uitvinding werkt (met verwijzing naar het door haar op 26 september 2011 uitgegeven persbericht), tevens bedoeld heeft te onderbouwen dat de onderhavige combinatietherapie een verbeterd of synergetisch effect heeft, kan haar dat niet baten met betrekking tot het technisch effect van de octrooien. Onderzoeksgegevens van na de prioriteitsdatum kunnen immers niet meetellen voor inventiviteit indien het geclaimde effect niet al aannemelijk is gemaakt in de oorspronkelijke aanvraag.<footnote-ref linkend="_f4373446-3c88-48de-ac74-07d91678caa6" /> Een dergelijk effect dan toch meewegen in het kader van de inventiviteitsbeoordeling zou niet corresponderen met de technische bijdrage van het octrooi en de octrooihouder zo een ongerechtvaardigd voordeel verschaffen.</para>
        <para />
      </paragroup>
    </paragroup>
    <paragroup>
      <nr>4.11.</nr>
      <para>Het voorgaande betekent dat het objectieve technische probleem dat de uitvinding volgens conclusie 1 van EP 603 oplost, kan worden geformuleerd als “het kiezen voor een alternatief voor een antineoplastisch middel dat in combinatie met exemestaan op vergelijkbare wijze werkzaam is tegen borstkanker”.</para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.12.</nr>
      <para>De vraag is vervolgens of de vakman zonder inventieve denkarbeid (‘<emphasis role="italic">would</emphasis>’) op de prioriteitsdatum (17 oktober 2001) zou hebben gekozen voor everolimus in plaats van de in WO 467 genoemde antineoplastische middel met de redelijke verwachting dat dit in combinatie met exemestaan werkzaam zou zijn tegen borstkanker. De voorzieningenrechter beantwoordt die vraag bevestigend en overweegt daartoe als volgt.</para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.13.</nr>
      <para>Alle alternatieven voor de in WO 467 besproken combinatietherapieën moeten immers als een oplossing van het gestelde probleem worden gezien, zolang van die alternatieven redelijkerwijs kan worden verwacht dat ze werkzaamheid behouden, een gemiddelde vakman deze in overweging zou nemen en hij ze op conventionele wijze kan synthetiseren zonder “<emphasis role="italic">undue burden</emphasis>”. Dat betekent evenzeer dat alle alternatieven die aan die voorwaarden voldoen, niet inventief zijn.<footnote-ref linkend="_135d06da-7a47-4587-8659-36d4f1966948" /></para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.14.</nr>
      <para>Anders gezegd, bij gebreke van een reden (zoals een onverwacht, verbeterd effect, hetgeen bij de combinatietherapie van het octrooi niet aan de orde is zoals hiervoor overwogen), is een keuze van één alternatief dat naar verwachting werkzaamheid zal hebben tegen aBC uit vele, willekeurig en aldus niet inventief te achten.<footnote-ref linkend="_7583cac8-e539-4fe6-917e-8858a38f2320" /> Novartis c.s. heeft die verwachting als zodanig ook niet (voldoende) betwist. Ofschoon volgens Johnston denkbaar is dat een combinatie van middelen antagonistisch werkt, is door Novartis c.s. niet aangevoerd dat dit bij everolimus in combinatie met exemestaan aan de orde was of dat de gemiddelde vakman de verwachting zou hebben gehad dat er sprake zou zijn van antagonisme.</para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.15.</nr>
      <para>Partijen zijn het er bovendien over eens dat de vakman vanwege de veel voorkomende en (te) vaak fatale therapie resistentie, steeds op zoek is naar nieuwe therapieën, waaronder combinatietherapieën. Zoals hiervoor overwogen, leert WO 467 de vakman dat aromataseremmers, en specifiek exemestaan, niet alleen gecombineerd kunnen worden met antineoplastische middelen, maar dat de combinatie van exemestaan met epirubicine dan wel docetaxel zelfs super additieve resultaten geeft bij borstkanker. Daarnaast is er op de relevante prioriteitsdatum een aantal aanwijzingen dat everolimus in combinatie werkzaam zal zijn tegen borstkanker (hoewel er in dit geval geen pointer nodig is, omdat voldoende is dat de vakman everolimus als alternatief zal overwegen). Uit de beschrijving van het stofoctrooi van everolimus (EP 916: zie onder 2.2) volgt dat van rapamycine, waarvan everolimus een derivaat is, bekend is dat het antitumorwerking heeft: “<emphasis role="italic">Rapamycin is an extremely potent immunosuppressant and has also been shown to have antitumor and antifungal activity</emphasis>.”<footnote-ref linkend="_d15f6a4a-d45d-4d1d-92ef-19c68640b0c9" /> Voorts is in de beschrijving opgenomen dat everolimus in het bijzonder bruikbaar is voor: “<emphasis role="italic">e) Treatment of proliferative disorders, e.g. tumors, hyperproliferative skin disorder and the like.</emphasis>”<footnote-ref linkend="_8e2409cb-1f5f-4ed1-9ad0-e1dc16532fda" /> In de literatuur in 2001 is door Yu et al. gewezen op de synergetische effecten van de combinatie van het rapamycine derivaat temserolimus (dat in de oorspronkelijke aanvrage nog specifiek wordt genoemd naast everolimus) met anti-oestrogeentherapie tegen borstkanker.<footnote-ref linkend="_e93dd44a-c1e4-4e58-b205-491365d75217" /> Dat artikel rapporteerde derhalve al synergetisch gebruik van een rapamycine derivaat in combinatie met hormoontherapie bij hormoonreceptor positieve borsttumor. Uit WO 317 leert de vakman voorts dat ook everolimus in combinatie met chemotherapeutica (somatostatine-analogen, specifiek octreotide) synergetisch effect vertoonde (zie onder 2.15.2, met name de tabellen). In WO 317 wordt voorts klinisch onderzoek naar borstkanker gesuggereerd (zie onder 2.15.2, met name onder “Clinical trial”). </para>

    </paragroup>
    <paragroup>
      <nr>4.16.</nr>
      <para>De voorzieningenrechter acht het voorshands voldoende aannemelijk dat de vakman op de prioriteitsdatum ertoe zou worden gebracht de combinatie van everolimus met exemestaan te proberen met de verwachting dat dit in de behandeling tegen borstkanker werkzaam zou blijken. Daarmee is EP 603 niet inventief te achten en EP 246 (dat uitgaat van de combinatie van everolimus met een aromataseremmer) evenmin.</para>
      <para />
    </paragroup>
    <paragroup>
      <nr>4.17.</nr>
      <para>Het voorgaande betekent dat in dit kort geding moet worden aangenomen dat er een gerede, dat wil zeggen serieuze, niet te verwaarlozen kans bestaat dat de octrooien EP 603 en EP 246 in een bodemprocedure (of bij het EOB in oppositie/beroep) ongeldig worden geacht zodat de vorderingen van Novartis c.s. voor afwijzing gereed liggen. De voorzieningenrechter zal de vragen daar laten of sprake is van toegevoegde materie en of, nu de OD EP 603 op die grond ongeldig had bevonden, hangende het beroep tegen die beslissing plaats is voor een voorlopige voorziening in deze zaak. Op de uitspraak van de OD was overigens al kritiek geleverd door Birss J van de Engelse High Court in een <emphasis role="italic">interim injunction</emphasis> beslissing van 15 januari 2019 tegen Dr Reddy’s ([2019] EWHC 92 (Pat). Birss J heeft in die uitspraak de inventiviteit niet beoordeeld (de voorzieningenrechter begrijpt uit r.o. 7 dat de inventiviteit in die procedure door Dr. Reddy’s niet is betwist).</para>

      <nr>4.18.</nr>
      <para>Novartis c.s. zal als de in het ongelijk gestelde partij worden veroordeeld in de proceskosten. Teva maakt aanspraak op vergoeding van haar volledige proceskosten overeenkomstig artikel 1019h Rv. Haar proceskosten (met specificaties onderbouwd) sluiten op € 226.566,- exclusief verschotten en exclusief BTW. Nu Novartis c.s. met betrekking tot de hoogte van de kosten geen bezwaar heeft gemaakt, zullen deze kosten aan de zijde van Teva worden begroot op (€ 226.566,- advocaatkosten + € ,639,- =) € 227.205,-, te vermeerderen met de gevorderde wettelijke rente.</para>
